Russian tourists who find themselves in a country dangerous for their life and health have the right to return the money spent for a failed trip. They got such an opportunity in accordance with the current legislation.
The administrative regulation No. 666, adopted by the Ministry of Culture of the Russian Federation, came into force on informing travel agencies, tour operators and tourists about the threat to the safety of travelers in places of temporary stay, during excursions and tourist trips, obliged operators to notify their customers about the possible threat to the life and health of vacationers in a certain country. After such information, the tourist has the right to contact his travel agency with a requirement to terminate the contract and return the funds spent on the dangerous trip to him. But this is only possible if the trip has not been completed in full.
All types of emergencies - natural, man-made, social or extraordinary, can become the reason for the termination of the contractual terms. These include warnings from the Ministry of Foreign Affairs when it comes to carrying out counter-terrorist operations in a particular territory, or about hostilities unfolding in the country. Rospotrebnadnazdor must inform the tour operator about cases of quarantine on the territory of a foreign state. Roshydromet is obliged to provide information on emergencies caused by meteorological conditions.
Based on the data received, Rostourism makes a decision to notify tourists about possible threats. Rostourism is obliged to place all the necessary information about them on its official website and in the media, print and electronic, through the operating "hot lines" and provide it to travel agencies and tour operators.
In accordance with article 14 of the law on tourism activities, citizens who have planned their vacation in a country recognized as dangerous to life and health due to climatic conditions, man-made situations or military events, have the right to apply to their travel agency with an application for the return of money spent on the trip. … If the operator refuses to reimburse the costs, the tourist should send his claims to Rosturizm, which undertakes to help resolve the disputed issue and provide the necessary legal advice. Rosturizm can also send an information letter to an illegal operator.
