Part 1 of Article 67 of the Federal Law "On Enforcement Proceedings" enables bailiffs to establish temporary restrictions on travel abroad for debtors. Is it possible to bypass this restriction without violating the law, or is it worth forgetting about traveling abroad for a while?
Instructions
Step 1
Make sure you have a travel restriction. This restriction can only be imposed by bailiffs on the basis of a court decision recognizing you as a debtor. Neither collectors nor bank employees have this authority. The decree on the restriction of leaving the country must be sent to your mailing address. Unfortunately, it is not uncommon for letters to not reach the recipient, and the debtor finds out about the existence of the restriction only at the border. To avoid such an unpleasant surprise, check the information in advance with the FSSP office.
Step 2
If the amount of your debt does not exceed 10,000 rubles, you can safely plan a trip abroad. An exit restriction cannot be imposed.
Step 3
If the amount of your debt is still more than 10,000 rubles, you can also leave Russia without breaking the law. The method used by thousands of travelers-debtors is to cross the border of Belarus, which does not have full-fledged border control. From the cities of the Republic of Belarus, you can freely leave to anywhere in the world by any type of transport. In some large cities of Russia, travel companies have even appeared, offering such a service as organizing travel for debtors through Minsk and Kiev.
Step 4
If traveling with transfers does not attract you at all, please note that the travel restriction is set for exactly six months. The restriction is not extended, but can only be re-imposed. In the latter case, the procedure usually takes from several days to two weeks. This time is quite enough to go abroad if, for example, you have long dreamed of going on vacation. In this case, you are not breaking the law, however, this method is not 100% effective due to frequent delays in updating the database of debtors.
