More recently, bailiffs received new powers. Now they legally have the right to impose on the debtor a temporary restriction on leaving the Russian Federation.
Based on what the restriction is imposed
First of all, it is worth understanding why the travel ban was imposed. As a rule, there can be only two such reasons: the order of the bailiff or the court.
Many debtors believe that this prohibition violates the article of the Constitution of the Russian Federation "Convention for the Protection of Human Rights and Fundamental Freedoms" dated August 15, 1996, but this is not the case. In this case, this article is inapplicable, and exit is limited on the basis of the Federal Law “On the Procedure for Exiting the Russian Federation and Entry into the Russian Federation” and the Federal Law “On Enforcement Proceedings”.
As a rule, absolutely everyone can get such a restriction. It is enough just one time not to pay taxes or fines.
However, these are trifles, there are also more serious reasons, such as non-payment of loans, alimony, housing and communal services, or having a criminal record without serving a sentence.
Some people mistakenly believe that if there was no trial, then there can be no question of a ban. But not everything is so simple, the basis for imposing a ban can be a decision of other bodies, such as: tax inspection, labor inspection, as well as police and traffic police.
Is it possible to lift the travel ban
But, if there is still a ban on leaving, is there a way to remove it?
As a rule, one of the easiest ways to solve this problem is to pay off current debt.
Also, if the ban on leaving was the result of a court decision, then it can always be appealed. Unfortunately, you don't have much of a chance of success. It usually just takes time and the result is the same.
Perhaps, these ways to remove the restriction are the only ones.
However, you should be aware that the decision to restrict travel is only six months from the date of its receipt by the regulatory authorities. After this period, it loses its validity. But, if the debt is not paid off, the resolution is extended.
However, if you nevertheless paid off the entire amount of the debt, this does not mean at all that tomorrow you will be released abroad. Removing the restriction takes at least three weeks. During this time, a new court order should be issued, which is sent to the customs department in Moscow. In practice, this process takes up to three months.
